1. INTRODUCTION

Thank you for choosing Erlebnistours Ltd. as your trusted travel partner. We are committed to providing exceptional travel experiences and ensuring that your journey is smooth and enjoyable.

These Terms and Conditions (“Terms”) govern:

  • All travel services booked with Erlebnistours Ltd.
  • The use of our website, social media pages, mobile applications, and online portals.
  • All agreements between Erlebnistours Ltd. and the client.

These Terms apply to all trips booked with us, irrespective of the year of travel.

In the event of any inconsistency between documents, these Terms and Conditions shall prevail unless expressly stated otherwise.

2. COMPANY INFORMATION

Erlebnistours Ltd. is registered in Tanzania with BRELA (Business Licencing and Registration Agency of Tanzania) under the number 184 922 290..

Throughout these Terms:

  • “Erlebnistours”, “we”, “us” refers to Erlebnistours Ltd.
  • “Client”, “traveller”, “you” refers to the lead booker and all members of the booking party.
  • The lead booker is jointly and severally liable for all participants.

3. PRIVACY AND DATA PROTECTION

We are committed to safeguarding your personal data in accordance with our Privacy Policy.

By using our website or contacting us via our communication channels, you consent to the collection, use, and disclosure of your personal data as described in our Privacy Policy.

4. MODIFICATION OF TERMS

We reserve the right to amend these Terms at any time. Amendments take effect immediately upon publication on our website.

Continued use of our website constitutes acceptance of revised Terms.

If Terms are amended after a booking has been made:

  • You will be notified by email.
  • Revised Terms apply from the date of notification unless you submit a written objection within 14 days.

5. INTELLECTUAL PROPERTY

All website content, logos, trademarks, and intellectual property are owned by or licensed to Erlebnistours Ltd.

You may not reproduce, distribute, modify, or publicly display our intellectual property without prior written consent.

6. PRICES AND SURCHARGES

6.1 Website Pricing
  • All prices are per person unless otherwise stated.
  • Prices are quoted in USD and EUR.
  • Website prices are indicative only.
  • Final binding price is stated in the formal quotation.
  • Quotations remain valid for three (3) weeks.

Not included:

  • Passport and visa costs
  • Border taxes
  • Tips
  • Travel insurance
  • Optional excursions
  • Personal expenses
  • Alcoholic and soft drinks (unless specified)
  • Seasonal supplements

We reserve the right to correct pricing errors before booking confirmation.

6.2 Surcharges

We reserve the right to correct pricing errors before booking confirmation.

  • Transportation costs (fuel, airfare, airline surcharges)
  • Landing and embarkation fees
  • National park or concession fees
  • Government taxes
  • Exchange rate fluctuations

Surcharges may be imposed from contract conclusion up to 20 days before departure.

If a surcharge exceeds 10% of the total travel price, you may cancel and receive a full refund.

Government-regulated fees in certain African countries may change without notice and will be passed on to clients.

7. BOOKINGS AND PAYMENTS

7.1 Booking Confirmation
  • A detailed itinerary will be sent by email.
  • The booking is confirmed only after written acceptance and deposit payment.
  • Services will be delivered as confirmed, subject to unforeseen circumstances (e.g., weather,road closures, security).
7.2 Payment Terms
  • 50% deposit within 10 days of invoice.
  • Full payment 61 days before departure.
  • Bookings within 61 days require 100% payment within 2 days of invoice.
  • International airline tickets require 100% payment within reservation deadline.

Failure to meet payment deadlines entitles us to cancel the booking and apply cancellation charges.

The lead booker is responsible for full payment on behalf of all participants.

8. CANCELLATIONS

8.1 Cancellation by Client
Cancellation charges:
  • 61+ days: Deposit non-refundable
  • 0–61 days: 100% of itinerary price
No cancellation fees apply where termination results from:
  • Substantial changes proposed by Erlebnistours not accepted by you
  • Unavoidable and extraordinary circumstances significantly affecting the trip
8.2 Cancellation by Erlebnistours
We may cancel due to:
  • Non-payment
  • Reasonable concern of non-payment
  • Failure to reach minimum participants (group tours)
Cancellation deadlines:
  • Trips over 6 days: 21 days before departure
  • Trips 2–6 days: 10 days before departure
  • Trips under 2 days: 48 hours before departure

9. MODIFICATIONS

9.1 Modifications by Client
Within 10 days of confirmation:
  • Error corrections allowed.
  • After 10 days: $150/€150 fee.
  • Flight changes always incur charges.
61+ days before departure:
  • Changes permitted (minimum 50% paid).
  • $150/€150 administrative fee.
  • Arrival postponement allowed once within 12 months.
  • $200/€200 fee applies.
  • Airline fare differences charged separately
Within 61 days:
  • No modifications permitted.
  • Treated as cancellation.
Replacing a Traveler
  • Request at least 7 days before departure.
  • Replacement must meet booking conditions.
  • $250/€250 administrative fee.
  • Additional supplier charges passed on.

Less than 7 days: treated as cancellation.

9.3 Modifications by Erlebnistours

Minor changes: communicated in writing.

Major changes:

You may:

  • Accept the change
  • Choose alternative
  • Request price reduction
  • Cancel for full refund

No compensation for force majeure or airline schedule changes.

10. LIMITATION OF LIABILITY

No compensation for force majeure or airline schedule changes.

  • Losses from unforeseeable information provided by you
  • Third-party actions not engaged by us
  • Business losses

Liability is limited to three (3) times the total travel price.

11. GROUP TOURS

  • Subject to minimum participants.
  • Confirmation no later than 20 days before departure.
  • If minimum not reached: full refund within 14 days.
  • No additional compensation.

Participants must respect itinerary and group conduct rules.

12. INSURANCE

Travel insurance is mandatory and must cover:

  • Medical expenses
  • Repatriation

Optional but recommended:

  • Cancellation
  • Evacuation
  • Baggage loss
  • Theft

13. TRAVEL DOCUMENTS

You are responsible for:

  • Valid passport
  • Required visas
  • Vaccination documentation

We accept no liability for invalid documentation.

Documents will be sent 2 weeks to 3 days before departure.

14. CARRIERS

Air and sea transport is subject to carrier terms and international conventions.

We are not liable for airline operational decisions, including:

  • Delays
  • Cancellations
  • Strikes
  • Baggage issues
  • Schedule changes

Liability remains capped at three times the travel price.

15. RISKS

Travel involves inherent risks including:

  • Wildlife encounters
  • Weather conditions
  • Disease exposure
  • Transport limitations
  • Limited infrastructure

You voluntarily assume these risks and must follow safety instructions.

16. FORCE MAJEURE

Force majeure includes unavoidable and extraordinary circumstances beyond our control.

In such cases:

  • Refunds are limited to recoverable amounts from suppliers.
  • No additional compensation is payable.

17. COMPLAINTS

Complaints must be:

  • Reported immediately during travel.
  • Submitted in writing within 28 days of return.

Failure to do so may limit our ability to investigate.

18. GOVERNING LAW AND JURISDICTION

These Terms are governed by Tanzanian law.

Exclusive jurisdiction lies with Tanzanian courts unless mandatory law provides otherwise.
